Notably, though Aguilar invested in three tokens, the complaint claims that all coins on this platform are actually \u201cunregistered security memecoins.\u201d<\/p>\n<p>Therefore, it says, the company made almost $500 million in fees by violating US securities laws.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">**LAWSUIT ALERT**<\/p>\n<p>Burwick Law and <a href=\"https:\/\/twitter.com\/WolfPopperLLP?ref_src=twsrc%5Etfw\">@WolfPopperLLP<\/a> have filed a second federal class action lawsuit on behalf of investors against the PumpdotFun platform.<\/p>\n<p>Full complaint available below.<\/p>\n<p>&mdash; Burwick Law (@BurwickLaw) <a href=\"https:\/\/twitter.com\/BurwickLaw\/status\/1885034093672280343?ref_src=twsrc%5Etfw\">January 30, 2025<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>The plaintiff has requested a trial by jury, seeking relief in the form of monetary damages and litigation costs. But the document added that the members of the proposed lawsuit are \u201cso numerous that joinder of all members is impracticable.\u201d There may be hundreds or thousands of them, it added.<\/p>\n<p>As defendants, the complaint names the UK-based <strong>Baton Corporation<\/strong> as the company behind Pump.fun, the platform itself, as well as three people <a href=\"https:\/\/find-and-update.company-information.service.gov.uk\/company\/14743013\/officers\">listed<\/a> as officers of Baton Corporation.<\/p>\n<h2><span id=\"guerilla_marketing_and_ponzi_schemes\">\u2018Guerilla Marketing\u2019 and \u2018Ponzi Schemes\u2019<\/span><\/h2>\n<p>The lawsuit makes a number of allegations against the company.<\/p>\n<p>\u201cPump.fun\u2019s core function is to work alongside influencers to co-issue and market unregistered securities,\u201d the complaint reads. \u201cInherent to its operations are a novel evolution in Ponzi and pump and dump schemes.\u201d<\/p>\n<p>Platforms like this use sophisticated marketing strategies that create the impression of legitimacy and security, it says. At the same time, they downplay the inherent risks and emphasize potential returns to enable and support speculative trading.<\/p>\n<figure id=\"attachment_8689\" aria-describedby=\"caption-attachment-8689\" style=\"width: 260px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-8689\" src=\"https:\/\/icobench.com\/wp-content\/uploads\/2025\/01\/Courtlistener-260x300.png\" alt=\"\" width=\"260\" height=\"300\" srcset=\"https:\/\/icobench.com\/wp-content\/uploads\/2025\/01\/Courtlistener-260x300.png 260w, https:\/\/icobench.com\/wp-content\/uploads\/2025\/01\/Courtlistener.png 723w\" sizes=\"auto, (max-width: 260px) 100vw, 260px\" \/><figcaption id=\"caption-attachment-8689\" class=\"wp-caption-text\">Source: Courtlistener<\/figcaption><\/figure>\n<p>It further alleges that the company utilized \u201cguerilla marketing,\u201d which it \u201cbenignly termed the attention economy,\u201d to promote the coins, grow its business rapidly, and support the mass adoption of these unregistered securities.<\/p>\n<p>\u201cPump.Fun\u2019s promotional materials consistently emphasize extraordinary returns, with statements like \u201c100x your money\u201d and \u201c222,222x growth\u201d presented as realistic possibilities,\u201d the document states.<\/p>\n<p>Notably, it reads, Pump.fun\u2019s mandatory fee structure ensures that every transaction of every token generates revenue for Pump.Fun and the three officers. Therefore, there is a direct financial interest in promoting and maintaining trading activity across all tokens.<\/p>\n<p>Moreover, the platform allows anybody, including minors, to create tokens in a matter of minutes without any basic investor protections. The plaintiff added that tokens on Pump.fun also lack any functional utility or real-world application.<\/p>\n<p>Another significant charge is that Pump.fun enables a marketplace of digital securities \u201cthat promote child abuse, potentially underage pornography, antisemitism, racism, self-harm, advocating violence, the continued and ongoing use of the unlicensed intellectual property.\u201d<\/p>\n<h2><span id=\"perverse_distortion_of_crypto_promise\">\u2018Perverse distortion of Crypto Promise\u2019<\/span><\/h2>\n<p>Among the tokens that the defendants actively promoted are the three that the plaintiff bought in late 2024: <strong>First Convicted Raccoon<\/strong>, <strong>FWOG<\/strong>, and <strong>GRIFFAIN<\/strong>.<\/p>\n<p>\u201cThe Defendants created clear expectations of profits through systematic marketing efforts between November 2024 and January 2025,\u201d says the lawsuit.<\/p>\n<p>First Convicted Raccoon (FRED) reached an all-time high (ATH) in November 2024, dropping 98% since. The coin is also down 84% over the past month.<\/p>\n<p>FWOG hit its ATH in November 2024 and fell 87% since. It\u2019s down 64% in the past month.<\/p>\n<p>GRIFFAIN recorded an ATH on 22 January 2025, falling 64% since. Overall, its price decreased by 41% over the past 30 days.<\/p>\n<p><strong>FRED all-time chart:<\/strong><\/p>\n<figure id=\"attachment_8690\" aria-describedby=\"caption-attachment-8690\" style=\"width: 300px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-8690\" src=\"https:\/\/icobench.com\/wp-content\/uploads\/2025\/01\/FRED-300x190.png\" alt=\"\" width=\"300\" height=\"190\" srcset=\"https:\/\/icobench.com\/wp-content\/uploads\/2025\/01\/FRED-300x190.png 300w, https:\/\/icobench.com\/wp-content\/uploads\/2025\/01\/FRED-768x486.png 768w, https:\/\/icobench.com\/wp-content\/uploads\/2025\/01\/FRED.png 833w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-8690\" class=\"wp-caption-text\">Source: CoinGecko<\/figcaption><\/figure>\n<p>However, the same firm, <strong>Burwick Law<\/strong>, filed another complaint against Pump.fun in mid-January on behalf of plaintiff Kendall Carnahan.<\/p>\n<p>At the time, they claimed that the platform was selling <strong>Peanut the Squirrel (PNUT)<\/strong> in violation of US securities laws.<\/p>\n<p>Moreover, Max Burwick, the firm\u2019s founder and partner, <a href=\"https:\/\/x.com\/burwick_max\/status\/1879565787792371991\">called<\/a> Pump.fun and memecoins \u201cmulti-level marketing scams, preying on human desperation.\u201d<\/p>\n<p>In his opinion piece titled \u2018The Promise of Crypto v. Crypto\u2019s Great Pretender,\u2019 he <a href=\"https:\/\/x.com\/burwick_max\/status\/1879565791076692206\">opined<\/a> that Pump.fun and similar platforms that \u201cexploit\u201d memecoins \u201chave nothing to do with advancing crypto\u2019s capabilities \u2013 they are a perverse distortion of its promise,\u201d he said.<\/p>\n<p>Meanwhile, Pump.fun just recently hit a new all-time high of $3.3 billion in weekly trading volume, following the launch of official US President Donald Trump-themed memecoins.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Popular Solana memecoin
