Depuis des ann\u00e9es, le pays \u00e9volue sans v\u00e9ritable boussole r\u00e9glementaire, coinc\u00e9 entre prudence mon\u00e9taire et opportunit\u00e9s \u00e9conomiques. Mais une proposition juridique in\u00e9dite pourrait bien changer la donne.<\/p>\n<p>Port\u00e9 par le cabinet du fonds Hashed Emergent, <strong>le COINS Act<\/strong> 2025 propose d\u2019appliquer <strong>une logique constitutionnelle aux actifs num\u00e9riques<\/strong>. L\u2019objectif est clair : <strong>sortir la crypto du no man\u2019s land juridique<\/strong>, restaurer la confiance, et positionner l\u2019Inde comme acteur cr\u00e9dible de la finance d\u00e9centralis\u00e9e.<\/p>\n<h2><span id=\"un_vide_reglementaire_paralysant\">Un vide r\u00e9glementaire paralysant<\/span><\/h2>\n<p>Depuis la lev\u00e9e de l\u2019interdiction bancaire en 2020, les choses n\u2019ont gu\u00e8re \u00e9volu\u00e9. Officiellement, <strong>rien n\u2019interdit la crypto<\/strong>. Mais en l\u2019absence de cadre clair, tout repose sur <strong>des circulaires temporaires<\/strong>, des annonces floues et des d\u00e9cisions parfois contradictoires des autorit\u00e9s.<\/p>\n<p>Comme le r\u00e9sume l\u2019avocat <a href=\"https:\/\/news.bitcoin.com\/indias-crypto-crossroads-coins-act-2025-offers-a-rights-first-roadmap\/\" target=\"_blank\" rel=\"noopener noreferrer\">Arvind Alexander<\/a>,<em> \u00ab on est dans un purgatoire r\u00e9glementaire \u00bb.<\/em> Pas d\u2019agence d\u00e9di\u00e9e, une fiscalit\u00e9 dissuasive <strong>(30 % sur les plus-values, sans compensation des pertes<\/strong>), et des banques qui coupent parfois les ponts sans explication. Nombre de startups ont d\u00e9j\u00e0 pli\u00e9 bagage : direction Singapour, Duba\u00ef ou Lisbonne.<\/p>\n<p>Pour Alexander, cette inertie ne menace pas seulement l\u2019innovation locale. <strong>Elle traduit un renoncement plus large \u00e0 d\u00e9finir les r\u00e8gles du jeu<\/strong> dans un secteur strat\u00e9gique.<\/p>\n<h2><span id=\"coins_act_une_approche_fondee_sur_les_droits\">COINS Act : une approche fond\u00e9e sur les droits<\/span><\/h2>\n<p>Dans ce contexte, le <strong>COINS Act 2025<\/strong> propose un changement de cap. Son principe central : <strong>reconna\u00eetre des droits fondamentaux aux utilisateurs de cryptomonnaies<\/strong>, au m\u00eame titre que ceux garantis par la Constitution.<\/p>\n<p>Parmi ces droits :<\/p>\n<ul>\n<li>la self-custody, c\u2019est-\u00e0-dire <strong>la d\u00e9tention directe de ses actifs num\u00e9riques<\/strong> ;<\/li>\n<li>la possibilit\u00e9 de<strong> transf\u00e9rer librement des cryptos<\/strong>, dans le respect de la loi mais sans surveillance syst\u00e9matique;<\/li>\n<li>la libert\u00e9 de coder, tester et <strong>d\u00e9ployer des applications sur des blockchains<\/strong> publiques.<\/li>\n<\/ul>\n<p>Ce mod\u00e8le s\u2019oppose \u00e0 la logique dominante, ax\u00e9e sur le contr\u00f4le et le filtrage. Il part du postulat que la transparence native des blockchains, combin\u00e9e \u00e0 la responsabilit\u00e9 individuelle, peut suffire \u00e0 <strong>assurer la conformit\u00e9.<\/strong><\/p>\n<h2><span id=\"un_coup_de_pouce_a_linnovation_locale\">Un coup de pouce \u00e0 l\u2019innovation locale<\/span><\/h2>\n<p>Le texte va au-del\u00e0 de la simple reconnaissance des droits. Il pr\u00e9voit<strong> la cr\u00e9ation de zones d\u2019exp\u00e9rimentation r\u00e9glementaires<\/strong>, permettant aux startups de tester leurs projets sans risques juridiques imm\u00e9diats.<\/p>\n<p>Il sugg\u00e8re aussi <strong>la cr\u00e9ation d\u2019un r\u00e9gulateur d\u00e9di\u00e9 aux crypto-actifs<\/strong>, distinct de la Banque centrale ou de l\u2019autorit\u00e9 des march\u00e9s. Ce r\u00e9gulateur aurait pour mission de d\u00e9livrer les licences, d\u2019assurer la coh\u00e9rence des r\u00e8gles, et de coordonner avec le l\u00e9gislateur.<\/p>\n<p>L\u2019id\u00e9e est simple : si l\u2019Inde veut garder ses talents et attirer des projets internationaux, elle doit<strong> offrir un minimum de stabilit\u00e9 juridique<\/strong>.<\/p>\n<h2><span id=\"une_reserve_strategique_en_bitcoin\">Une r\u00e9serve strat\u00e9gique en Bitcoin ?<\/span><\/h2>\n<p><img decoding=\"async\" class=\"alignnone wp-image-4708 size-full\" src=\"https:\/\/icobench.com\/fr\/wp-content\/uploads\/sites\/5\/2025\/07\/Reservoir.jpg\" alt=\"Bitcoin btc reserve\" width=\"1280\" height=\"853\" srcset=\"https:\/\/icobench.com\/fr\/wp-content\/uploads\/sites\/5\/2025\/07\/Reservoir.jpg 1280w, https:\/\/icobench.com\/fr\/wp-content\/uploads\/sites\/5\/2025\/07\/Reservoir-300x200.jpg 300w, https:\/\/icobench.com\/fr\/wp-content\/uploads\/sites\/5\/2025\/07\/Reservoir-1024x682.jpg 1024w, https:\/\/icobench.com\/fr\/wp-content\/uploads\/sites\/5\/2025\/07\/Reservoir-768x512.jpg 768w, https:\/\/icobench.com\/fr\/wp-content\/uploads\/sites\/5\/2025\/07\/Reservoir-600x400.jpg 600w\" sizes=\"(max-width: 1280px) 100vw, 1280px\"><\/p>\n<p>Le volet le plus surprenant du projet reste sans doute la proposition de constituer une r\u00e9serve nationale en Bitcoin.<\/p>\n<p>Selon Vishal Achanta, juriste chez Hashed Emergent, il ne s\u2019agit pas de sp\u00e9culer, mais de <strong>diversifier les r\u00e9serves nationales,<\/strong> aujourd\u2019hui largement d\u00e9pendantes du dollar et des obligations d\u2019\u00c9tat.<\/p>\n<p>L\u2019\u00c9tat pourrait acheter de petites quantit\u00e9s de <a href=\"https:\/\/icobench.com\/fr\/news\/btc-bull-fin-presale-24-h\/\" rel=\"\">BTC<\/a> sur le march\u00e9 ou consolider des avoirs saisis dans le cadre d\u2019affaires judiciaires. Une strat\u00e9gie prudente, mais symbolique : elle acterait <strong>l\u2019entr\u00e9e du Bitcoin<\/strong> dans la r\u00e9flexion budg\u00e9taire et mon\u00e9taire d\u2019un grand pays en d\u00e9veloppement.<\/p>\n<p>Est-ce r\u00e9aliste ? Pas pour tout de suite. <strong>La Banque centrale n\u2019a pas comment\u00e9 l\u2019id\u00e9e<\/strong>, et il est peu probable qu\u2019elle s\u2019y rallie ouvertement. Mais le fait que la question soit pos\u00e9e change d\u00e9j\u00e0 le ton du d\u00e9bat.<\/p>\n<h2><span id=\"une_proposition_pas_encore_un_projet_de_loi\">Une proposition, pas encore un projet de loi<\/span><\/h2>\n<p>Il faut toutefois rappeler que le COINS Act n\u2019a, \u00e0 ce stade, aucune port\u00e9e l\u00e9gale. Ce n\u2019est pas un texte du gouvernement, mais <strong>une proposition priv\u00e9e,<\/strong> \u00e9labor\u00e9e par des juristes du secteur.<\/p>\n<p>Cela dit, la publication prochaine d\u2019un papier de consultation officiel sur les crypto-actifs pourrait ouvrir une fen\u00eatre politique.
